The Consumer Product Safety Commission published two rules on November 8, 2011 which focus on reducing the testing burden for manufacturers of toys and children's products.

16 CFR 1107
Applicable to products manufactured after February 8, 2013, this rule provides three periodic testing options for product certification and an option for compliance labeling:

Option 1: Test representative samples once every year with CPSC approved 3rd party laboratory following a periodic testing plan only.

Option 2: Test representative samples once every 2 years with a CPSC approved 3rd party laboratory if following a production testing plan that provides a high degree of assurance that products continue to meet applicable children's product safety rules.

Option 3: Test representative samples once every 3 years with CPSC approved 3rd party laboratory if performing production testing with ISO 17025 laboratory.

Each option also requires recertification after any material, component or process change that may affect product compliance.

Also, the rule permits manufacturers and private labelers to indicate compliance with all applicable consumer product safety rules by labeling product with "Meets CPSC Safety Requirements"

16 CFR 1109
Effective December 8, 2011, this rule provides additional options for product certification.

• Sets requirements for component part testing and traceability of the results

• Allows use of test results from component and finished product suppliers that meet the conditions and requirements of the rule
